No casino for Rosemont

While authorization of riverboat gambling will enhance investment, development and tourism in Illinois, it is recognized that it will do so successfully only if public confidence and trust in the credibility and integrity of the gambling operations and the regulatory process is maintained.

In mid-1997, one of this state's 10 licensed casinos went bust near East Dubuque, a victim of competition from Iowa riverboats. For 11 years, the unbridled greed of Illinois politicians and would-be millionaires frantic to reactivate the so-called 10th license has, paradoxically, kept it dormant. It produces no revenue for Illinois.

Finally, that could change. The Illinois Gaming Board intends, by year's end, to decide where to license a new 10th casino. The board Tuesday will hear rival proposals for three finalists, Des Plaines, Rosemont and Waukegan.

Owing to Rosemont's sorry history in its long-rampaging quest for a casino, we urge the IGB to unequivocally exclude that community and instead choose Des Plaines or Waukegan. Awarding a casino to Rosemont would profoundly undermine the "public confidence and trust" that the Riverboat Gambling Act demands. That's the baseline requirement if citizens are to believe that state-sanctioned gambling will give taxpayers—and patrons—a fair shake.

To review the bidding: In 1999, Rosemont Mayor Don Stephens persuaded state legislators to relocate the 10th license to his suburb.

The Gaming Board, though, refused to let a casino open there, concluding that Rosemont was tainted by mob influence.

But in 2004, a reconstituted IGB did vote 4-1 to allow a casino in Rosemont. Gov. Rod Blagojevich, like his predecessor, George Ryan, had pressured the board to get a casino up and running. As Gary Peterlin, a former state's attorney and the only IGB member to vote against a Rosemont casino, put it, Springfield pols hear "casino" and think "easy revenues," not "potential for crime."

Atty. Gen. Lisa Madigan, determined to protect Illinois gambling by protecting its integrity and reputation, attacked the IGB's choice of Rosemont. She charged that, "There appear to be connections that Don Stephens and the city of Rosemont had to organized crime." She detailed accusations that Stephens had personal and business ties to organized crime figures, and that mob-linked contractors had been hired to work on the Rosemont casino. She also alleged that Rosemont had tried to pressure a prospective operator, Emerald Casino, to hire the mob-linked contractors—and to sell casino stock to mob-linked cronies of Stephens.

Stephens, who spent decades vehemently denying allegations of mob connections, died in April 2007 and the casino companies involved in earlier Rosemont proposals aren't players this time.

With Don Stephens gone (his son Bradley now is mayor), why should the Gaming Board continue to steer clear of Rosemont?

• Bad acts should have consequences. Rosemont is a potential site today in part because of its prior conniving. Example: Rosemont at one point illicitly let Emerald begin building a casino without crucial approval from the IGB. Why? To create the public impression that the casino was a done deal. The town even built parking for the casino to further that charade of inevitability.

In 2002, Rosemont nudged Emerald into Bankruptcy Court so the village could press its claim against the company—$45 million for the parking construction, plus hundreds of millions more for lost revenues and other alleged damages associated with the casino that Emerald couldn't open there. The resulting lengthy bankruptcy case is a major reason the 10th license still isn't producing revenue for Illinois. Rosemont's brazenness shouldn't be rewarded with a lucrative casino.

• In her 2004 report, Atty. Gen. Madigan alleged mob ties not only to Stephens but to Rosemont itself: "[I]t is critical to note that Rosemont has relentlessly attacked the IGB's regulatory powers in both state and federal courts over the past several years. . . . Why is the IGB seriously considering placing the 10th license in a community that will surely fight the board in its efforts to regulate the [casino] licensee?" Good question then—and now.

• The new bidders for a Rosemont site are credible and respectable business people. They could seek to insulate themselves from the village's influence. But casinos are vulnerable to pressure: Local governments that provide police support, award municipal licenses and enforce codes can exert pressures to hire this person or firm, or to otherwise mollify local officials.

• Licensing a Rosemont casino would, according to the current bids, bring an upfront $435 million to the state. That's more than $200 million higher than the current bid to put a casino in Waukegan, and more than $300 million higher than the bid for Des Plaines. Remember, though, that grabbing for quick bucks is what got Illinois where it is today. The revenue a casino produces is a long-term proposition, and the upfront money is just one factor of many: The most valuable casino location is one that doesn't risk tarnishing the reputation of the entire Illinois casino industry. Rosemont simply cannot pass that test.

• Madigan says she's concerned about a Rosemont site—just as in 2004. Many times she has protected Illinois officials from their worst urges for a get-rich-quick casino deal. Organized crime allegations have hit Illinois gaming twice in this decade. We expect that Madigan will do whatever it takes to make sure scandal doesn't strike here a third time.

The IGB has two better options. It can choose a Des Plaines site some 1.5 miles from the proposed Rosemont site and be comfortable that the state will, over time, collect similar tax revenues in the O'Hare area. Or the board can pick Waukegan and attract Illinoisans and Wisconsinites without cannibalizing the existing Illinois casinos.

By enhancing the "public confidence and trust" that state law demands, the IGB also protects the health of an Illinois casino industry that in 2007 sent $833 million in revenue to the state.

To that end, the Gaming Board should reject a Rosemont bid and send the 10th license to Des Plaines or Waukegan.
