The Regional Superintendent's office has notified Waukegan Public School that Superintendent Donaldo Batiste, Deputy Superintendent Jules Gaudin, Executive Director Rich Pattison released confidential files of thousands of students and employees on a CD that was personally reviewed by Board Attorney Tom Morris of Hinshaw and Culbertson. The records and files contain both students, former students, employees, former and retired employees confidential information. The records and files contain social security numbers, names, addresses and many other types of confidential data.

"It" was an FOIA request for 3 years of Katherine's emails delivered to Superintendent Dr. Donaldo Batiste on 4/22/08. I requested the CD of her Outlook files because my original paper FOIA request was missing emails that were important to her case. Not only were those emails missing but others as well when I started going thru the CD. As I went thru the CD, I realized that emails that were missing sometimes had an email that was confidential right next to them that contained thousands of confidential records for example. They did not advise me of a single file or email that could not be supplied via FOIA, for example an email containing bank account records, social security records along with names and addresses. They went thru her emails and very thoroughly focused on deleting emails that incriminated them but bypassed emails that contained your students or your employee information.
In my first meeting with the Asst Regional Superintendent last year, he told Katherine and I not to give up any of the evidence that we brought to his office. When I told him this time that I was not planning on giving up the CD because it contains evidence of several crimes, he told me he was not asking for it and I shouldn't give it up. I further explained that this is a problem because part of the evidence of 'intent" is that they deleted an email sandwiched between confidential emails and I believe shows Board Attorney Tom Morris' intent because he wrote several letters claiming to have reviewed her emails and assured everyone that he and Executive Director Richard Pattison made sure all of her emails were there. Finally, in another letter to I believe the Illinois Attorney General he suggested that Katherine may have deleted emails (after she no longer had access and wasn't an employee.) Mr. Morris nice try, but she didn't release thousand of records - all of you did, you know after your comprehensive review. Most of the emails that we wanted were on the CD but contained in the text of replies from staff to her deleted emails. We were able to piece together enough records to show that they had destroyed school records in an attempt to back up their fraud, false entries and forged records.
I may be banned from this site for responding to your question, but felt that it was very important for all of you to be aware of the above disclosure and have an opportunity to handle it and be aware of why I cannot give the CD back. I will need to continue to share it when appropriate. I'm sorry that your records are caught in the middle. I didn't create this situation. You will need to speak with the administration, board attorney and board about that. And for those that don't get involved in "personal situations" - how about thousands and thousands or tens of thousands of them?

I've tried to write a response three times now to take you to task for, once again, using this forum as a place to air your grievances with the district. Your three paragraph long 'explanation' to Penguin was far more than what was required to answer her questions. This is your 'Get Out of Jail Free' card.
