Am I misunderstanding? This isn't just a total LC f### up but also involves FMLA? That's a different story.

Been there, done that!! FMLA can be a cluster ####. Government doesn't like it, companies don't like it...neither wants to pay out....the family gets screwed if the filer doesn't pursue all avenues.

Just FYI.....rumor in the district is that the claim is in excess of $100,000.00 Is that true?

Are you aware of the Civil Immunities section of the Illinois Statutes,
(745 ILCS 10/) Local Governmental and Governmental Employees Tort Immunity Act.?

Unfortunately public employees in Illinois are immune from civil damage claims unless you can prove they acted with willful and wanton conduct, which can be very hard to do.

Two pertinent sections:

(745 ILCS 10/2‑201) (from Ch. 85, par. 2‑201)
Sec. 2‑201. Except as otherwise provided by Statute, a public employee serving in a position involving the determination of policy or the exercise of discretion is not liable for an injury resulting from his act or omission in determining policy when acting in the exercise of such discretion even though abused.

(745 ILCS 10/2‑202) (from Ch. 85, par. 2‑202)
Sec. 2‑202. A public employee is not liable for his act or omission in the execution or enforcement of any law unless such act or omission constitutes willful and wanton conduct.
(Source: P.A. 84‑1431.)

Just thought you should be aware of this in case you were not.
