The question of the mental fitness of the Waukegan man accused of trying to kidnap a 10-year-old girl to have sex was resolved Tuesday.
Danny Carbajal, 25, appeared before Lake County Circuit Court Judge Fred Foreman for a ruling to address the status of his mental fitness. Carbajal's attorney, Cynthia Pruim Haran, had previously requested her client undergo mental fitness evaluation.
Foreman ruled the defendant is fit to stand trial.
Pruim Haran verified her client does not have any diagnosed mental disorders.
Carbajal is charged with aggravated kidnapping and attempted predatory criminal sexual assault. The kidnapping charge carries a potential sentence up to 30 years in prison, and the sex charge is punishable up to 15 years in prison.
According to Assistant State's Attorney Bodie Haxall, Carbajal tried to abduct a 10-year-old girl from her yard. Police reported that he walked up to the girl, asked where her mother was and then grabbed her and walked away. Other children in the yard started screaming, so Carbajal put her down and rode away on his bicycle.
Carbajal is due back in court for a hearing May 26.
